Fraudulent Foreclosures and Impediments To Judicial Remedies


Toward addressing the NATIONWIDE FORECLOSURE CRISIS, some helpful facts & information is posted at the Law & Grace website.  BY USE OF DEFUNCT Mortgage Companies, or via companies which are no longer holders of the note TOO MANY FORECLOSURES ARE EITHER FRAUDULENT, or the foreclosures should be postponed until compliance
with repossession statutes.  Unequivocally, IN CONJUNCTION with property foreclosure is the EMPLOYMENT of Debt Collectors. However, debt collection abuse contributes to much of the foreclosure problems.

Valuable insight toward addressing the NATIONWIDE MORTGAGE MESS can be gained from looking at the appalling example of LOUISIANA wherein it is HIGHLY COMMON for some debt collector attorneys to file foreclosure (called "Executory Process") proceedings: (i) in the name of a DEFUNCT mortgage company; (ii) in the name of a mortgage company which is NO LONGER holder of the security interest / the promissory note;  or (iii) file foreclosure proceedings wherein those attorneys AFFIX a 'ransom' amount (their fee) far exceeding what the promissory note "Acceleration Clause" authorizes.  When either of those 3 illegalities occur in foreclosures, the property owner IS UNLAWFULLY LOSING HIS /HER PROPERTY.

In almost all instances where fraudulent foreclosures are being accomplished, some MORTGAGE LENDER benefits because it then becomes enabled to FLIP the fraudulently obtained foreclosed property.

Notwithstanding, properties which become flipped as a result of fraudulent acquisition ACTUALLY ENTITLES the property owner to CHALLENGE  CONTRARY-TO-LAW loss of his / her home.  BUT property owners LACK consumer and legal knowledge, the Court System is REFRACTORY, and there is a SHORTAGE of attorneys with acumen to pursue
this area of Consumer Law!  (Sometimes attorneys advise the filing of  bankruptcy cases as the best option; BUT the attorneys rarely discuss  adversary proceedings within the bankruptcy case.)

In the State of Louisiana, CRONYISM and JUDICIAL CORRUPTION are the salient reasons why unlawful foreclosures are sanctioned. FURTHERMORE, in Louisiana, 2 mortgage companies that benefit from fraudulent foreclosures are Wells Fargo and FREDDIE MAC!  In fact, the Louisiana Division of the Justice Department, as well as various legislators
--including U.S. Senator David Vitter repeatedly has been informed about fraudulent real estate activities in this State.

Since you seem to want to editorialize on what other people post, and control this forum, why don't you start your own.  You can then read what is posted here, and go to your own blog and post your negative comments, then read them.

Here is just one free blog.  It is very easy,   There are also free forum web sites, however, off the top of my head, I can't recall the addresses right now.

I agree. Someone is roaming this site and jumping on every post against fraud in the mortgage industry or negative posts about judges McDonald and Anderson. The truth hurts. Our economy is in a tailspin from foreclosures. People are suffering.  Read through the past posts and a pattern emerges. They then label other posters as ranters for exposing the truth.

You must be a collection attorney who fears the ruination of your gold mine.  Or, the spouse of one?   And, I might say, you could have at leasted waited until after the Holiday to display your callousness toward the homelessness from which you likely profit.

 Keep exposing the foreclosure fraud!  There are a ton of collection attorneys in the Detroit metro area involved in this corruption.  Some that I know for a fact - working for housing associations to steal the equity in your home:

Wayne Wegner
Jeffrey Vollmer
Shane Diehl

These three comprise the firm of Wegner & Associates, P.C. in St. Clair Shores, MI. 

One of  thier tactics is to participate with HOA to create bogus dues arrearage by misappropriating funds, etc.  And, there courtroom tactics in passing off fraud are unsurpassed.
