Procedures for a 170.1 Motion
Procedures for a 170.1 Motion
Does anyone know the actual procedure for a 170.1 Motion in Family Law Courts? We filed a 170.1, alleging and proving bias, unfairness, prejudice,etc... to get out of Department L, and had a court date set for 12/3/2008 in Department K. The Commissioner in Department L took the motion and summarily denied it this week (YES, almost two months before the hearing date).
Can the Commissioner you are accusing of Bias and Prejudice take over the 170.1 motion and rule on it months before the court date?
Oh - and he also denied our 170.6 Motion as "Untimely", even though it was filed the requisite Five Days before any evidentiary hearing was held on a contested matter. Any help or advise you can give is appreciated.

One thing i can tell you for sure, he can't rule on a motion like that but he always does. Him and Andy Tytell need to be stopped and brought to justice before one of our kids die! We need to unite and file formal charges against them for ciminal acts.

I have already filed formal complaints against this commissioner - and I am hoping that the "watchdogs" will help us out.
