Quit Claim Deed


About 10 years ago I signed a quit claim deed giving my now exhusband our home.   I did not know at the time that it did not take my name off of the mortgage.  If I had known I would have never done it.  In the past ten years he has not stayed current on his house payment and goes 2 to 3 months without making payments.  This has ruined my credit and I can not even put my name on the house my new husband and I own.  Is there anything that I can do about this at all?

My husband had the same exact problem. It was pure h**l for him to clear himself; but in the end he did. Lots of phone calls to the bank. This went back 18 years for him. Never knowing she was behind until they found his address and drove him crazy. I was told there was two things to do.. Have the ex contacted by a third person and said unless they release your name from the mortgage { they would have to send a letter to their bank and if the ex is in good standing with the bank, the bank should release it} that you want and is entitle to a steak in the house. Even if the name is off of the deed the mortgage still counts for something. This came from our attorney. If the ex won't do this you need to have all the paperwork over the years from the bank that the mortgage was made to, showing your either refiancing or any paperwork where your name isn't on it. You have to prove you have not lived there.  Good luck it can be done but lots of work to get it there.
